At 10 AM this morning, after days and hours of deliberations, the jury sent a note to the judge indicating that they could not reach a unanimous decision. The jury was sent back to continue deliberating for the remainder of the day, and the day ended with NO VERDICT.
That has left a lot of people, including me, wondering whether this case is headed toward a HUNG JURY.
In my opinion, that would be a horrible miscarriage of justice. Regardless of whether you believe Lindsay Clancy belongs in prison or in a psychiatric facility, I think we can all agree that Lindsay needs help.
Today we’re going to discuss how long the judge could make this jury continue deliberating before ultimately declaring a mistrial.
We’re also discussing the reports about jurors wearing pink in the courtroom. I can now confirm that this is not simply an allegation or rumor. Sources I have inside the courtroom have told me directly that they personally saw someone wearing pink.
And then there is the biggest question: If there is a hung jury and a mistrial, will the Commonwealth retry Lindsay Clancy?
Technically, a mistrial caused by a hung jury does NOT automatically mean Lindsay immediately walks free. The Commonwealth could choose to prosecute the case again, and her custody status would still have to be determined through the legal process.
But I personally do not believe the Commonwealth will retry this case if the jury hangs. If prosecutors ultimately decide not to pursue the charges again and the criminal case comes to an end, Lindsay Clancy could eventually walk away from this case without a criminal conviction.
